Employment and Labor Laws in GCC Countries
GCC which is constituted of six countries is a single largest block for expatriate employment. These are the rich countries and single largest exporter of oil and gas in the world. GCC consists of Qatar, Kuwait, Saudi Arabia, Bahrain and Oman. Saudi is world’s top rank oil exported and Qatar is way ahead in gas. These countries are fully dependent on expatriate workers for the skilled and non-skilled jobs.
Kingdom of Saudi Arabia is biggest of all countries. The KSA population is 27 million of which almost 18 million or 70 percent are Saudi’s and 30 percent or 9 million or less are expatriate population.
UAE is second biggest by population in GCC. As per data available the UAE population is almost 8.6 million people of which 90% are expatriates. In term of economy also, UAE is second biggest economy of the region and transshipment hub.
Kuwait is third biggest country with 3.3 million population of which 1.1 million or 33 percent are Kuwaiti’s and 66 percent are the expatriates. Kuwait is one of the biggest oil exporter in the world and economy is basically driven by oil.
Oman is relatively poor of all countries with around 3 million populations. It is not a big exporter of oil and its position is more coming from mines and mineral industry. Nationalization is highest in Oman.
Qatar is around 1.5 million population. The economy and population is fastest growing. Qatar is fast growing state which has known fast going after big sporting event. Qatar was the first Middle East country to host Asian games in 2006 and will host FIFA world cup in 2022. Qatar is biggest exporter of gas in the world.
Bahrain is smallest of all with around a million or less in population. Financial sector along with oil and gas plays important role in growth of Bahrain.
These are the rich countries with Qatar standing as second richest in the world as per the IMF 2011 data with more than $ 100,000 per capita income, others are not far behind with UAE the world rank 4 and then Kuwait, Saudi and Bahrain.
Employment and Labor Law
There are two categories of the visas, employment visa and house work visa (maid visa) and farming visas. Domestic workers and farming workers are not part of labor laws. Employment visa is issued to companies and establishments and house work visa are issued to the every family. Every local family is issued five visas for house work but they can apply and get more visas issued for some payment.
Employment visa is issued based on the size of company and its capital. Every local can establish and business enterprise and can get visa, these may be big companies or may be small shops. The law always favors owners.
The underlying principle of GCC countries is “hire and fire”. GCC countries have failed to establish internationally acceptable standards for migrant workers. Most GCC countries’ labor and immigration laws facilitate and validate inhuman treatment towards migrant workers. These laws are abusive, and as a result they control, restrict, and infringe on all internationally accepted standards of “fair dealing” towards millions of migrant workers. Employers frequently withhold wages for months and confiscate passports as “security” to keep workers from quitting. The combination of “recruiting fees” and abusive work environment constitute “forced labor” in this region.
Khiraj – Exits Permit – Except Kuwait and UAE all other countries needs permission of employer to leave the country. Even if the employee has his passport he needs permission of the employer so that he can travel abroad.
Sponsorship – This is system where if employee wants to change his job and join another job he need the permission from his present employer or change it. Unless and until permission is granted jobs cannot be changed. Transfer of sponsorship is allowed in restricted categories only. The issues affecting expatriate workers in the Gulf region are different from the migrant population in other regions of the world. The most important difference is the “temporary status” of the expatriate workers in the Gulf countries.
Trading in Visas – This one more phenomenon where local national provide to the expatriate worker and takes a fixed charge every year. He is not responsible for any thing of the worker. Local nationals establishes companies may be fake or real and sale these visas. A worker buys visa and is self-employed.
Salaries – I will divide it into marginal labor, blue collar jobs and white collar jobs. The marginal labor is one of most exploited class of workers. ( ALL Wages and Salaries are monthly basis)
The marginal labor – Cleaning company workers and construction workers along other marginal workers are highly exploited class. They paid least between USD 150 to USD 250. The wages are very irregular. Sometimes they are delayed for six months and sometime never paid. These are highest number of workers. Those who work in small shops are usually paid USD 250 to USD 500 depending upon working hours. Cost of living is very high. 20 to 30 marginal workers live in single apartment of 2 bedrooms. (700 sq. ft. – 850 sq. ft.) Saving is very difficult in this situation.
Blue Collar Jobs – These are the jobs of companies or self-employed. They are paid USD 750 to USD 1750. In this category the heavy and super heavy drivers and all kinds of mechanics and machinist are in demand. Their exploitation is relatively less than the marginal workers.
White Collar Jobs – These are best jobs, usually offered by good companies or relatively better one. Accountant, engineers, doctors, and investment banker are the best profession. Teaching is good option but salaries of the school teachers are not lucrative enough. College and university professors are senior or retired professors of Europe. They are most in demand at university level. They are available relatively at less cost compared to young professionals.
The salary structure varies a lot. A fresh accountant start with USD 700 to USD 800, experienced CA, CPA, CMA depending upon qualification and experience gets between USD 2000, Chief Accountant, Finance Managers, AVP and VP can fetch USD 3000 to USD 10000 and above. CFO can get up to USD 10000 to USD 20000 per months.
Engineers are the second in demand. Construction is one of the most important industry of the region and has very important role to play.
The best industry to work is Oil and Gas. This is the industry is at core of the wealth of the GCC region. It is best paying industry in the region. These are Government owned industry or subcontractor to the industry.
The other best industry in this region is banking and investment. This is one of shining industry in this region. This region is wealthy region and you need wealth managers. This industry has always done great. This is best industry as pay master. A salary varies from USD 5000 to USD15000 for senior managers.
House Work Visa – Maids and Agriculture Labor
This is most exploited class of workers. They work in homes or they buy it and work outside. Every national family gets five such visas. They can get some more by paying nominal extra money to the government. This class of workers does not covered by labor law.

This is Mohammad again, as per your guidance I have asked bank to arrange for a settlement letter, they have agreed to do so in coordination with the collection agency in Bahrain.
The bank is repeatedly asking about my whereabouts and contact details which I have not given till date.
Shall I share my contact details with the bank?
@Mohammad - Legally if there is case and you are absconding then yes, but may not be so if only banned.You can not be arrested in Saudi, you can only be barred from entry and deported back to country of origin.
@Adam - There is no issue to go to Abu Dhabi and work there. There is no problem in visa issue in Abu Dhabi.

I checked with the local consultant in KSA, he says that if you are banned from travel in Bahrain, you may be arrested in Saudi Airport. I want to be safe in KSA and do not want to be arrested in any KSA airport.
Is there any way to check this?
@Shaik - It will depend upon the kind of case. If it is financial then can be solved, but if it is major criminal then may affect your Saudi Residence in long run not immediately.
@Mirdesh - You can safely go and work in Oman no problem. You can also start talking to bank for settlement and pay the amount and get clearance.
@Michelle - It depends upon what kind of ban is. If it is as per regular labor law practices then yes it is for 6 month, if company has made up something else then it need to be cleared by court.
@Deep Banarjee - The offer looks OK not high not low. Double check the leave, ask for attested contract from embassy, this is standard practice so that they can not cheat you, Saving potential is very good, they are paying for food and accommodation, transportation then depending upon your life style, you can save upto SAR 3500, on basic salary.
Double check leave, it is 21 days annually.
Also check about over time, this makes you real money. Usually those working there during pick season make more money on OT than salary.
@Shaker md - No body knows how much time it will take. It should not take more than 15 days legally but never works that way.
@Mohammad - When you are making payment make it through legal channels. Make it very clear from day one they will issue a case closer and clearance certificate. Secondly once you paid and get no dues then you can also approach the court if there is any ban to revoke it and it can be revoked. It will not affect your travel to Saudi and any other GCC country.
I am working in Saudi Arabia, have defaulted HSBC bank loan in Bahrain because I was terminated from my job in May 2011.
I am in touch with the bank for the settlement, they have agreed for the payment plan, the bank is not giving any information regarding the legal status of case, I am afraid that bank might have imposed travel ban on me in Bahrain and it will affect me in Saudi Arabia and international travel.
Please advise on will the travel ban / legal action in Bahrain will affect me in Saudi Arabia.

I will be deployed in ***** company as there out sourced unit in
charge and I have to look after entire Housekeeping activity and

Now my queries are:
1. How is the offer?
2. How are staffs there?
3. Cost of living?
4. How much money I can save from there?
5. And how is job security?
6. Is it authentic job offer?
7. Is there any chance or provability that after reaching there if the company won’t fulfill all the commitment which they have mentioned in
OFFER LETTER?
8. After reaching there if I found they are not fulfilling all the
said benefits, what action I can take?
9. During the employment if any emergency accrued in my home in that
case can back to India ?

I had mentioned earlier that i got a cancelled visa from Bahrain before coming home to my country knowing that i could go back to another sponsor, but i came to know that i was banned without any reason, and according to your advice this is done by some employers as provision, Sir can you give me any idea how long could be the ban or blocked could be applied? For i got some information that i have to wait for 6 months, and i can go back again?.

I was working in dubai for last 5 years and got personal loan. Now the total outstanding is around 2.50 thousand dhs/-. unfortunately I left dubai last year (2011) without settle the loan dues since I lost my job. However, I have got offer in oman(muscat) but what my doubt is can I enter oman and work safely without any issues or I might be caught by immigration? I heard that the bank has filed a case against me but not criminal one. please kindly suggest.

i have a valid resident visa of saudi every 6 months i make reentry to saudi and my iqama is still valid now i have this crimnal case in uae if i make passport in india and travel to saudi directly as i have a visa so in future when uae would blacklist me bcoz of my case then will i have a problem in saudi???
as of now i have done my finger prints and scanning in saudi and uae as i have residence visa of both countries now i have a good opportunity in saudi so by making passport under the same name and transferring my visa from my old passport and travelling to saudi will i have a problem from my case root of uae??

@Shaik - yes there is all possibility that you may be arrested if they put your case under common platform for criminals which GCC shares.
@Saeed - first don't call them at all. send them e mail and wait for response. Once you get response then only you can further the process. friend may not be of use and should not be used.
@Umar Farooq - yes company can sue you for amount and if they register a case against you then you can be banned from GCC. You can be arrested anywhere in GCC.

i was working for a company in dubai and unfortunately got linked in a criminal theft case which has been registered in uae, Iam out on bailby keeping my own passport as guarntee and probably inshaallah i will leave uae by means of an outpass to india.
If i make a new passport with same particulars of my name and family by means of outpass or other source in india can i travel to saudi arabia or qatar ... will there be a problem now or in near future as i have a criminal case in uae and once the court hearing is done then uae would blacklist me if not present for the hearing.

@mohammed - if you don't have loans and credit card debt or any other major issue with your company then you can travel easily to other GCC countries.

@Imran Md - if it is Interpol then they should come to your home. What your source saying may not be true. It depends upon nature of crime. Petty crimes usually does not constitute warrant. Can only be issued by court. Without court case there can not be warrant.
i had a warrant from saudi and the official pardon has been done 1 year back. i came to know by means of some friends there in saudi,that it was informed to interpol also.it might be informed to all international airports and if i travel internationally they may arrest me. my question is,
if iam still wanted by interpol than when going for international airport of my country,police authorities may arrest me in my country only or not?

@Sunev - this case should not affect your travel to Saudi, check through Saudi embassy in your country using some good lawyer.
@Scali - How can I promise you anything, if amount 500,000 QR, then is big amount and bank can go to court and declare you criminal offender and if convicted then you can be banned but this is not the regular case, use some good lawyer from Qatar through your embassy so exact situation can be resolved.
@suresh - there is no ban unless and untill there is case in court against you, you can travel to any country in GCC without any issue.

@Ubed - The status can only be known from banks loan recovery department. There will not any problem in travelling to any country other than Saudi.
@Scali - You can travel to Saudi, you can not be arrested unless there is Interpol warrant against you. There may not be any issue in going to Saudi Arabia.
@Sunev- This depends upon cause of deportation, there should not be any problem in to Saudi Arabia.

@Shamsuddin - This does not work like this, you can only be banned when a person complaints and case is registered. Only a court settlement or acquittal by court. You must go to court for all clearances then and then only you will be removed from banned and it will take some time.
how would we know if my bank dues in saudi has been informed to interpol or not? as if it is informed to interpol than it may be wanted globally and can be deported to wanted country on any international airports.
how to check wanted by interpol or not as web site of interpol may not display all wanted cases of fraud.

is it like the person gives in writing to police with two witnesses that he has no dues remaining on the other person? with this paper,what does police do? do they remove the case and issue police clearance certificate at the same time or they take some time to issue PCC?
@Saeed 77 - You can contact bank loan recovery department directly and can negotiate the settlement with them with condition that they will give Police Clearance Certificate and if there is any case they should remove it and give the clearance. Apart from this you can go to other GCC countries also.

@Michael - They may have did it when you terminated contract itself and cancelled visa. Instead of coming back you should have transferred your residency to new company. This practice is very common in all GCC country when some one terminate contract and ask to go back they make it like this so that he can not come back to another employer. If new company is strong then they can revoke it. It is not because of case but because of labor law which has this provision.
Hi! Was just wondering if you can give me an idea or advice, i had worked in Bahrain for 10Years, and i came back to my country Philippines last February, i am supposed to go back to go back Bahrain with another sponsor for i was already terminated by my old sponsor and i got home with my cancelled visa, In this connection i had a strong faith that i could go back to the same country for i have an offer even, but unfurtunately when they got to process my visa they find out that i was banned in the immigration or re-Entry, which makes me confused is it possible to make a case and ban a person without any evidence, and investagation?

@Shaker md - They may have filed the case and after that they will ask court to ban your entry and declare wanted. In such civil suit matter bank will take may ask some agents to try to recover money. apart from this not much action is expected.this will not affect your employable in other gcc countries.
@Bahrain is liberal like Dubai. There are no restrictions on women wearing cloths. At present security situation is tense.

i came back to my country on exit re entry visa from saudi.there is personal loan from alrajhi bank half paid by me in two years time periode regularly.as after coming back it was not possible for me to pay that remaining amount.what will be the case like? will bank file a case against me?uptil now they havent contacted my by any means? total amount was like 70,000 SAR and paid amount in two years was like 37000 SAR
@Anshad - if you are wanted for crimes by records then it will show up. But if you are just banned without any major incident or you are not wanted in Saudi, then there should not be any issue.
@Jaffar - They does not share complete database, every country manages specific data of its own. What they share is basically some criminal records and Interpol list of wanted people for crimes.

@asharaf 56 - don't go to agent, go to embassy and ask for new passport they will issue fresh without any problem.
The procedure is first complaint to police or inform embassy, after giving information after one month they will issue new passport to you. Don't go to agent and don't take passport from them, this is illegal and you may be arrested for this.
@Binu Sulochanan - first ask your company if they willing to stamp your Qatar visa along with Saudi visa. If they say yes then only leave Saudi otherwise wait some time and ask company to give exit.

@Binu Sulochanan - you can stamp legally, it depends upon your company. If they are willing to stamp then it is allowed, ask them if they are willing.

As I understand I summarize in this way, "the bank only can file case in UAE which will leasd a ban in UAE only and nothing to do with Interpol for 82k AED".
Beliving that there will not be any problem in Qatar for my work/permanent visa, I am planning to go ahead to Qatar. SUre will talk to the bank directly and settle the amount in few installments once I join the coy in Qatar.

@Coolguy4moman - The bank can not use a self check against you, usually it is only a pay yourself check, this can lead to police case and then court case this will lead to your ban in UAE but can not lead to any serous problem.
If you want to repay then you should talk directly to bank recovery department directly and they will agree on base amount due i.e 40K AED and may also give you discount but credit card cases not serous issue, if they threaten you with physical harm just put a police case against them and the person who is calling you, take down his name and phone number and register a police case against him.

@Coolguy4moman - No bank can not transfer case to Qatar, if you to settle, talk directly to bank settlement department and just ask them for basic amount due and discount and they will happily agree on this, and there is nothing to worry. Just sent a good e-mail that you are willing to pay.
@Coolguy4moman- Don't worry agencies can not do much except threatening and there can not be check bounce case, if you have not issued any check. You can go to Qatar and stamp permanent visa without any issue. They legally bank can not do much on this issue, and there can not be Interpol warrant and they don't have time to search you for 40K AED.
If you want to settle, just go to bank branch or talk directly to the collection department, they will accept the basic payment due and even will give you installment and discount. This is not a big case and there is nothing to worry about. Only court can issue Interpol arrest warrant when you are wanted in criminal case, big one and not on civil suits of banks.

@Biju Pillai - no, only once they are stamped and the person enter the country it become recognized, otherwise it is only a plain document.
@Biju pillai - you will need police clearance certificate from country of residence.

@Shehzad - You should ask for PCC and court clearance otherwise you will always remain wanted and if arrested they will deport you to wanted country. You can only be safe if you get PCC and Court clearance, even if arrested you can contest in the court of arresting country and even responding country will have to give you clearance.

@Shehzad - you can check from your country of residence or from Interpol website. Even if there is still wanted when they verify before deporting then they will let you go.
@Shehad - usually local police inform you if case is like of credit card or bank loan or employment related from GCC country then they will not do much. The citizens are usually even if arrested never deported to third third country.

@Noor - If Interpol warrant is issued they will inform your place police station also as address in passport, secondly check status of case from court or if you have any channel who can verify these details from court or banks.
@ Shehzad - Interpol does update their site regularly but process to remove name from list is tedious and lengthy. They will not come to know while issuing visa, they will only come to know only when you physically enter the country.

As if its a case of wanted by interpol than i shouldnt get a work visa for any countries??? like when my application was under process for cotract visa for oman,immigration section refused issuing visa by saying that thers some problem in saudi. and now as i have a ready job visa other than GCC than i think it should be confined to GCC only.i know you have suggested me to not to take chances ,but my concern is, if its a interpol warrant than i may not get work visa for any other country like oman as they may come to know in immigration check.

@ Ro - Yes because interior looks after demography of the country and has nothing to do issue of visa which is done through ministry of labour and social affairs. Usually no chances of rejection.

@Noor - Unless and until there is Interpol warrant against you they can not arrest you, even if they stop you from entering Oman, then they will send you to your country of origin. Unless and until your case is finalized they will not issue any arrest warrant because it is a financial case. Bank default and credit card default cases are not a big case and are civil matters so don't worry.
@Christopher - If this is court verdict then yes it can be handed over to Interpol for arrest and can be executed across the world.

At present i am working in saudi arabia close to five years. there is a criminal case for me in bahrain for submitting counterfiet travellers chq's and now they have given verdict of six months imprisonment. however i have appealed and the case is still going on. my question is if they issue arrest warrant in bahrain will it apply to saudi as well, is there anything called a GCC arrest warrant? my lawyer in bahrain says that yes there is something like that, but i dont trust him fully because he might be just wanting to drag the case more and more. pls advice.

@Ro - Once work visa is issued you have enough time so don't worry, it is companies responsibility to give you visa at earliest. It should not take more than 2 weeks to complete everything.
@Sarfaras - Qatar police can not arrest you on this money matter even if there is case unless and until Interpol red corner is issued.
Secondly they will send you back to your country of origin and not to UAE.
Don't worry, if you have good luck then there should not be any problem.

@Ro- Qatar has different system than other GCC countries, usually every year ministry decides how many new visa expected so they decide on what should be demographic composition, during the year this is limits.
When individual company goes asking for new visa they issue them mixed nationalities depending upon requirement of the company. Then visa is issued.
In Qatar practice is after getting permit, the company gets commercial visit visa and the person can come and then it will be converted to permanent residence.
@ Md Tufail- If you have all document and with PCC - police clearance certificate and and case is closed then they should remove it many times it may not be removed so you have to go to court to remove it.
2. He can get tourist visa or visit visa because at the time of application they can not find you but when you enter they can find you and you can be in problem.
3. If they issue visa does not mean anything because they can not find you at the time of application, they can only find you when you enter.

@Shaad Anwar - Banned is for criminal activity and there is no difference between work or tourist visa. Person is banned from entry because of criminal precedence. They may not reject application because they can not find you at the time of application but they can find you when you enter and you may be in problem.

@ Diet- If the reason was case in Saudi then it should be told to him, basically when they did not renew your visa, it may be different reason, because of new Nationalization policy in employment, if you have not face court in case then there can not be ban or case in Saudi, I do not see any linkages between these cases, the banned can only be processed through court order with reasons and depending on specific case.If they left you out after two days means they have not registered any case and you are not forwarded to court.The punishment for such cases is very harsh, this may be excuse for not renewing your visa. Almost 300,000 to 500,000 Philippians are expected to lose job in Saudi over the next 3 years.

Ans: We were in jail for 2 days last March 0f 2008 then we were deported last June 15 of 2010 after we renew our iqama.

Ans: My friend entered Qatar after 6 months of deportation from Riyadh, KSA. Then he took his vacation here in the Philippines this January of 2012. Then he was deported last month of 2012. I dont know the exact reason of his deportation except that he claimed that the qatar is now updating banned cases from other GCC Countries...
Please help me resolve this issue if I still need to grab the opportunities in Qatar or rather stay here in Philippines...

@Diet - If case is finished and you are pardoned then there should not be any issue. You need to know exact reasons for deportation of your friend because once visa is stamped they can not deport you from airport like this, unless and until there is something in Qatar system.
I was in jail for 3 days in Saudi Arabia together with my friend due to homosexuality. After 3 days, we were released and went back to normal life. After 2 years, we are scheduled for renewal of Iqama, then this time we faced the problem because the issue that we had before was not yet solved. We did the process, went to Police and Motawa office but unfortunately they decided to implement a big punishment to us which are 200 slashes and one year imprisonment. By the way, we did not do anything when motawa took us, they just simply brand us that we are homosexuals. Although, they cannnot find any materials from us thats why they send us back to our work during our 2 days in jail. Then, my company lawyer filed a letter to the king thats why the punishment was literary gone but the king want us to be deported. To make the story short, we were deported to philippines. After 6 months, my other friend who were with me in jail applied in qatar and h eworked their in medical aspect. For two years he did not face any problem. But, when he went for vacation and went back to qatar then he was facing problem. As what he told me, qatar is now updating banned people from other GCC countries to send back to their origin. Now, he was deported again but I dont know the exact reason why he was deported except that qatar is updating banned people from other GCC countries. @Sarah - Under what crime she is arrested, if arrested just for absconding then they will deport him, your embassy will provide you full support in this matter. There is no punishment for absconding, if she is booked for any other crime then you have to fight legal case. @Drol - if bank knows you are leaving and put stop exit at immigration then you will be stopped, if they do not know and you regular in installment payments you may not come under scanner and leave without problem.

@ Jabbar Hussain -No they can not do, unless and until there is red corner notice, still they can not arrest you and deport to Saudi.
It is better if you go through a legal channel, i.e advocate who regularly deals with embassy matters. Embassy do not easily entertain individuals.
You can also directly write to banks and ask for payment details and they will provide and then you can pay credit card dues with their partner bank or directly.
You can work in GCC, there is no issue.

I worked for saudi in government sector 2 years back.came back to india on re entry visa and did not g back. i had a criminal case in saudi and which has been solved by forgivness from the opposite party.some how i forgot to take PCC before coming back to india. IS it possible to get PCC from saudi by any means?
dear brother, can i go in person to saudi embassy of my country to discuss the matter ,do they have right to take us in custody and deport to saudi if we have any financial matter pending in saudi like unpaid credit cards,unpaid bank loans.Does saudi embassy ask for any ones arrest by means of local police in pending money matters?
Have you ever suggested anybody to consult saudi embassy for settling down unpaid credit cards bill and unpaid bank loans .if so ,than had it happened without any problems? Did he follow up with u with any news?
BLACK LISTED in GCC means wot? in my case they sometimes said that i have been black listed in GCC.after solving all these financial banking problems,will they remove this tag of black list from me? or i should forget working in GCC?
@Sarfarasan - if there is ban with criminal case then you will face problem.
If the case is settled and deported with ban then you can enter Qatar, there should not be any problem.

@ You can go get other countries visa and can work in other countries. What you can not do is transit through Kuwait.
You can settle Kuwait Case through proper channels.

@Jabbar Hussain - if there is some issue then passport may not make difference. To find out what is the problem is important, may be the the company not speaking the truth.
If there is problem and you are caught then there will be no remedy so please don't take chances.

@ Jabbar Hussain - You can not go to KSA even on umrah visa, the case and the matter can be settled through Saudi Embassy in your country of residence or your embassy in KSA, apart from this you can settle this through lawyers office but best option is embassy.
This case should not effect your entry into Oman and there may something else. Please do not take risk of going to Oman on tourist visa.
i worked for k.s.a ministry of health for 3 years and got back to my native country on emergency leave on exit re -entry visa, but due to some family issues couldn`t get back to saudi again. my exit re- entry visa expired 2 years back.i had dues of my personal loan towards al rajhi bank,and one EMI scheme of one year due on me from jarir book shop and a due of credit card.In my absence there was a police case against me and a warrant issued agaist me in locals money matter.I have done tanazul for this police case also and have a paper of tanazul with me too.now two months back i have applied for a job visa in oman. from oman it has been said that theres some problem in immigration and they did not issue me visa for oman.all i want to know is
1] what would be the problem?? can i go for a tourist visa to oman`,or will it be a problem ? or
2] will it be a problem to go for a umra?
3] if i want to clear this mess by legal means in saudi, than which is the legal consultancy i should trust on?
4] i checked online for my landline phone bills and internet,its still increasing every month.i couldn`t give any application for closure of these services to STC while coming on exit re- entry visa as i was planning to get back to saudi again.

@ Theoretically yes, if they put you as criminal and wanted on international airports then no, those wanted for financial fraud and major crimes like murder and drugs can be arrested when in transit. Just for the case of absconding may not be, it is better not to use transit.

@If you are living there from 2009 then it means you will need PCC from your country of residence i.e. Pakistan.
3. There is nothing like formal clearance from UAE company, unless and until your company specifically ask for it, this is not requirement for visa in KSA.

1. Before cancelling your visa and leaving Dubai you need to repay your all dues, this is legally binding.
2. base on approval you can get commercial visa or work visa, based on companies choice, if it is commercial visa then usually no need of medical, otherwise you can do medical even in UAE and it is valid, PCC you can get from local their itself no issues, because you are living there for more than 6 years.

1.I have some unpaid credit card (basically easy instalment plan)which i need to pay on monthly basis. Will there be any problem while cancelling visa in dubai, there is no default from my end at any given time since 6 years.I will be paying it to bank once i join duty in qatar.
2. I have got an apporval for my work permit, now they have to convert it in my name... what is time frame required to convert the work permit to my name and will there be any complication.
3. Do i need to get the medical done in india? Also do i need to attest my certificate in india (qatar embassy).

Hi Zia, A quick question, I worked with a big concern in UAE for about a year and came back in 2009 to Paksitan after which I didnt go back due to one reason or the other. Further, I had some credit cards which honestly i didnt pay off. I checked with a good frined of mine who is in UAE and has in access to UAE's Immigration system that my name and passport is coming as 'Matloob' means wanted becaused of a police case filed indeed by the bank.
Now with this background, I have got an offer from Saudi Arabia, so my questions are:
1. If my iqama is not cancelled for UAE, can it create in getting residence permit for KSA?
2. KSA visa requirements tell that one need to have a police certificate to get thourgh with residence permit, does it mean the Police Certificate from my Home country or UAE?
3. Is there any requirement to get a formal clearance from my previous comapny in UAE to get my visa processed for KSA?

@Asheed - The data is shared but I have not seen any such case till date. The risk may be there, In my opinion you should take a chance. In practice even people deported from Kuwait came back here without any issue, only thing is they managed the file, or remove it from data base itself, these are all possibilities, and I have seen it happening here.

I have still one last inquiry and i really need a enlightenment. I just spoke with someone that he said he is familiar with the situation like mine now. he to told me something like these " yes you can get a Qatar visa and you can enter in Qatar with out any trouble even though you have a previous deportation history in other GCC country. But by the time your employer will process your resident permit or aqama in Qatar that's the time they will know your history, simple because your name will be appearing on the database of Qatar". He also told that GCC has a shared database since second quarter of 2010. Please give a enlightenment honestly until now i don't know what to follow. will it be better for me to back out on this job opportunity? I understand that if the Qatar government will deport me they will send me back to my country. But considering that fact that it will be a waste of time, money effort on my part and my employer.

@Asheed - As of today they do not have centralized system and do not share employment related issues, they are trying to build and implement a centralized system, it is yet years away. But you can not go to KSA. Secondly at the most they can deny you entry and send back to India but they can not send you to KSA or any other third country. As of today GCC do not have centralized system for fingering and personnel ID mapping.
I have a follow up question, since i have a deportation history in KSA years back ago and now i am planning to work in Qatar. My fear is if i reach the emigration at qatar and do the finger prints and eye scan, is there any way that they can trace my history of deportation in KSA? Is it true that finger prints and or eye scanned in KSA could be access by other GCC country? Some say that GCC has a centralized computer system.Do you know someone that has same situation like mine which is successfully working in other GCC country now a days?

@ Shareef- GCC is not linked and if you do not have case or banned then there is no issue of going to other country. Even if there is an violation in one country does not make u non eligible for other country in GCC.

@Ali - It is possible to transfer with same sponsor excluding the banned nationalities and categories of countries which are at present not issued new visa.

@Hamada - You can travel to any other country there is no issue, if you come to Kuwait they will caught you. You can settle with company and bank through legal means and revoked your travel ban in Kuwait.

@Claret - It usually takes one week to two week to get visa and then it is valid for 30 days to arrive in Qatar. The company has choice bringing you in commercial visa and then converting it into work visa, this is most common practice. This visa is issued in 3 to 5 days and also valid for 30 days.

@Ayesha - there is no multiple entry visa fir maids category, it will be good if you check her passport and see the details on the passport, what kind of visa she is using and entry exit dates and every time on different visa. Only maids passport can tell the truth.
@babu -when you came on entry visa means when you leave Saudi Arabia, it will be automatically cancelled. You can take new job in Dubai no issues.

@Claret - Mr. Claret Qatar usually allocate how many visa's to be issued to different countries every year, and this depends on demand and they issue visa to companies based on availability of visa for that category and company. Your company should not have any problem in issuing visa to you. There is no ban on Visa for Indian in Qatar. You can enjoy your marriage peacefully.

@aysha - The first thing is Saudi can only have maid visa in there own country but it can not be stamp in Dubai, if she stayed there for 2years, what was the procedure for exit, because she must have exited with paying fine or what kind of entry visa is stamp on her passport in Dubai or UAE. Legally she can not stay there for so long without resident permit. The details of travel ban can be find out from e portal of government or from ministry of interior.

i dont know if this question has already been asked and answered, but its a very complicated situation, so please help me in this. i have a maid(from india) who was previously employed with a saudi family (saudi nationals)in saudi for a period of 4 years. after this she was asked to travel with them to dubai for a period of 2 mnths with just a entry visa. But following this, the family settled in dubai and so she was employed there for 2 years. she had returned to india 9 months back. but there is no other maid visa for dubai or an extension of the entry visa. there is just a stamp saying exit on the entry visa. there is also a mention of her entering india 9 months back. but how could she have stayed in dubai for 2 complete years without holding a maid visa? or is that possible for the locals there? also how do i check if she has a life ban or something on her from entering dubai? i am very perplexed and dont know whether i can apply for a visa for her now to take to dubai...please help! thank you.
hello sir, i dont know if this question has already been asked and answered. but let me explain in detail as this situation is confusing. i have a house maid (from india) who has previously worked with a saudi family (saudi nationals). she says she had worked in saudi for 4 years and then the family took her to dubai along with them saying that it was just for 3 months, but they apparently settled there and she was employed there for a period of 2 years. the passport just has a entry exit visa and mentions that the visa if for 2 mnths. but she says she has been employed there for 2 complete years and returned only after that period was over. but there is no other employment visa or anything mentioning that the visa has been extended or anything. the entry- exit visa just has the exit stamp on it. but it has been mentioned that she has entered india after 2 years. it has been 9 mnths since she has returned to india. the confusing bit is how could she stay in dubai for 2 years just with the 2 mnth visit visa? will there be a problem if i apply for a visa for her and take her to dubai now? also how do i check if she has got a ban or something on her from entering dubai. i am extremely perplexed. please help! thank you

@Prajith and @ Nadeem - Legally you can go without cancelling Kuwaiti Aqama No 18 but practically Saudi do not stamp second aqama unless and untill you cancel or after 6 months, if you have good company then they can get through it, Qatar do stamp second aqama, i.e. without cancelling Kuwaiti Aqama.

@Rajesh - They should not reject it legally, in UAE you can stamp visa even if you have Saudi or any other GCC country work visa. There may me some other reason for the same.

@ margie - Yes it is possible. Kuwait's Labor law is much flexible than most others and with new law it is very much labor friendly. But all work visa is banned till new government formed, i.e. First week of march.

@michael - You can work in other countries their is no issue in that. The old company may have blocked your Saudi Entry, this is usual practice when they don't want the employee to come on other visa. But you can work any other country without any issue.

@afzal - Some countries need exit permits to go out of countries, Saudi Arabia and Qatar, some does not like Kuwait and UAE. All of them present employers consent to change job and Police Clearance Certificate from Residence country or Native country.

Only UAE may stamp new visa without cancelling Bahrain Visa. One condition may hinder and that is Police Clearance, and if your new employer ask for clearance from old company.

Only work visa in UAE can be stamp with Saudi Visa. If you have maid category of VISA then it is not possible. You have to first cancel Saudi Visa.
im cuurently working in jeddah as family driver with aqama valid till july 2012 but ive got a better offer from dubai. It is possible to avail working visa from uae without cancelling by existing aqama
Only UAE stamps aqama with other GCC countries aqama. In Saudi you have to cancel your Kuwaait aqama before Saudi aqama can be stamped.

The Dubai is worst of all for paying salaries for labor and other expatriates workings. Dubai is built on blood sucking practices of construction companies and this is one of the moany reasons why dubai failed.
GCC is suffer a lot because of there discriminating policies. Here poor people suffers a lot. there is no life in this desert. They hold salaries for many months. This is a common practice in Qatar and UAE. Think twice and always find the accurate inside situation of the Company before joining.

@Mohammad -You can share the details with bank, I don't think there will be any problem. If collection agency makes any threat or any other kind of problem then you can report to the police station against the agency and person for threat to life and I think it is safe.
